Terms of Service

These Terms of Service ("Terms") govern your use of the Off The Rack
mobile app and offtherack.soreva.company (the "Service"), provided by
Soreva LLC, doing business as Off The Rack ("Off The Rack", "we", "us"). By creating an
account or using the Service, you agree to these Terms.
1. Eligibility
- You must be at least 18 years old.
- You must be a resident of the United States with a valid US shipping address.
- You must have the legal capacity to enter into a binding agreement.
2. Accounts
You can create an account by signing in with Google or Apple. You are responsible for maintaining the security of that account and for all activity under your Off The Rack account. Notify us immediately at support@soreva.company if you suspect unauthorized access.
Verifying a mobile number is required before you can purchase, and a mobile number can be verified on one account only. Attempting to operate multiple accounts to gain additional entries is a breach of these Terms.
3. How giveaways work
Influencers list clothing items they are giving away. Each item specifies how its winner is chosen:
- First come, first served — the first eligible entrant wins.
- Random draw — one winner is selected randomly from eligible entrants at the deadline. If a draw reaches its deadline with no entrants, the giveaway is closed automatically and the influencer is notified.
- Influencer picks — the influencer selects a winner from eligible entrants at the deadline. If they have not selected a winner within five days of the deadline, the giveaway is closed automatically and all entrants are notified.
- Campaign drop — the item is part of a campaign: a series of giveaways released over time with a shared leaderboard, where the winner is determined by leaderboard rank rather than by any of the methods above. Campaigns are covered in full in section 4.
An influencer may withdraw a listing before a winner is selected. If they do, the giveaway is closed, every entrant is notified in the app, and no winner is chosen.
No purchase is necessary to enter a giveaway. Standard-entry giveaways are free to enter. Some items may additionally offer a paid "Storefront + Free" entry path that does not improve your odds of winning in any draw-based giveaway; the free entry path gives identical odds.
If you win, you will be notified in the app. To receive the item, you must complete payment of shipping and the platform service fee within the timeframe stated in the app. If you do not complete payment in time, your claim is forfeited automatically: where other eligible entrants remain, the item passes to the next entrant; otherwise it is returned to the marketplace or closed. You may also release a claim yourself before paying, with the same result.
Storefront codes. Where an influencer issues redemption codes, each code may be used once and expires 90 days after it is issued. An expired or already-redeemed code cannot be used, and the app tells you before you commit to anything.
If a listing is removed. We may remove a listing that breaches these Terms or our Community Guidelines. Where the listing itself is the problem but the item is not, orders already paid for are still honoured and will be shipped to you. Where an item must not be distributed at all, we may cancel a paid order; if that happens we will contact you. Shipping and platform service fees are non-refundable — see Support if a removal affects an order of yours.
4. Campaigns
An influencer may run a campaign: a series of giveaways ("drops") released over time, with a shared leaderboard. Campaigns work differently from the standalone giveaways in section 3, and the rules below apply to them.
- Entry is free. No purchase is necessary to join a campaign, to enter any drop within it, or to appear on the leaderboard.
- How the leaderboard is scored. When you join, you get a personal share link. You score when someone new joins that campaign through your link and completes entry. You cannot score from your own link, and each invited person counts once — inviting the same person repeatedly, or using additional accounts, does not increase your score.
- How drops are awarded. Each drop is awarded to the highest-ranked eligible entrants at the time it closes. Someone who has already won a drop in the same campaign is normally excluded from later ones, so prizes are spread across participants. If a drop closes with nobody having scored, the winner is selected at random from the entrants, so the item is still awarded.
- Community goals. A campaign may set shared targets that, when reached, unlock additional winner slots, an extra item, or the next drop. These are described in the app when they apply.
- Winning. Winning a drop works like any other giveaway: you are notified in the app and must pay shipping and the platform service fee within the stated timeframe, or the claim is forfeited.
- Cancellation. An influencer may cancel a campaign, and we may cancel one that breaches these Terms. If a campaign is cancelled, any drop not yet awarded is closed and entrants are notified.
Attempting to manipulate a leaderboard — including self-referral, operating multiple accounts, or automated or artificial traffic to a share link — is a breach of these Terms and may result in removal from the campaign, forfeiture of a prize, or termination of your account.
5. Fees
Items themselves are given away at no cost. Winners pay only:
- Shipping cost — calculated by shipping tier (envelope, small box, medium box, large box, or custom).
- Platform service fee — a tiered fee shown to you before you authorize payment.
All amounts are quoted in US dollars and are charged by Stripe. See the Privacy Policy for how payment information is handled.
Non-refundable. Shipping costs and platform service fees are non-refundable once payment is authorized. Off The Rack is a platform that connects winners with influencers; we do not take possession of items and do not ship them. Items are shipped directly by the influencer, and we cannot control or guarantee whether or when an influencer ships, or the condition in which an item arrives. If a card issuer reverses a charge, the corresponding claim and any pending shipment may be cancelled.
6. Influencer obligations
By listing an item, an influencer represents that:
- They own the item and have the right to give it away.
- Images and descriptions are accurate and not misleading.
- They will ship the item to the winner within a reasonable time after payment, using the selected shipping tier.
- They will not accept additional payment from winners outside the Service.
7. Prohibited conduct
You agree not to:
- Create more than one account, or use automated means to enter giveaways.
- Impersonate anyone, misrepresent your affiliation, or provide false information.
- List counterfeit, stolen, illegal, unsafe, or prohibited items.
- Harass, abuse, dox, or threaten other users.
- Circumvent, disable, or otherwise interfere with security-related features of the Service.
- Use the Service in any way that violates applicable US federal or state law.
8. User content
You retain ownership of content you submit (photos, descriptions, comments, reviews). You grant Off The Rack a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely to operate and promote the Service. You represent that you have the rights necessary to grant this license.
9. Reviews and ratings
Reviews must reflect honest first-hand experience. We may remove reviews that violate these Terms or applicable law.
10. Intellectual property
The Service, including its name, logo, design, and software, is owned by Off The Rack and protected by US and international intellectual-property laws. Except for the limited license to use the Service as intended, no rights are granted to you.
11. Termination
You can stop using the Service and delete your account at any time via Delete Account. We may suspend or terminate your access if you violate these Terms or if required by law. Sections intended to survive termination (e.g., intellectual property, disclaimers, limitation of liability, dispute resolution) will continue to apply.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Off The Rack disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Off The Rack is not responsible for the condition, quality, legality, or safety of items listed by influencers.
13. Limitation of liability
To the fullest extent permitted by law, Off The Rack will not be liable for indirect, incidental, consequential, special, or punitive damages. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to us in the twelve (12) months preceding the claim, and (b) one hundred US dollars ($100).
14. Indemnification
You agree to indemnify and hold Off The Rack and its officers, directors, employees, and agents harmless from any claim, loss, or liability arising out of your use of the Service, your content, or your violation of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue there. Nothing in this section limits your rights under applicable consumer-protection laws.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
